Contractors must put their license number in all advertisements. Unlicensed contractors may advertise to do home improvement work valued at less than $500, but must state in their ads that they are not licensed contractors.

Handyman Insurance, B&P Code requires contractors to include their license number in all advertisements.

Those without licenses are permitted to do work valued at less than $500, but must state that they are not licensed in their ads. B&P Code also prohibits contractors from soliciting a down payment greater than 10 percent of the total contract price or $1,000, whichever is less. There is an exception to the down payment provision for about two dozen contractors who purchase special consumer protection bonds and are noted on the CSLB website.

CSLB urges consumers to remember the following tips when hiring a contractor:

* Be especially hesitant when approached by someone offering home improvement services door-to-door.

* Verify the contractor license by checking online at www.cslb.ca.gov, or via CSLB’s automated phone system at 1-800-321-CSLB (2752).

* Ask to see a photo identification to make sure you’re dealing with the correct person.

* Don’t pay more than 10% down or $1,000, whichever is less. There is an exception to this for about two dozen contractors who have special bonds for consumer protection that are noted on the CSLB website.

* Don’t pay in cash, and don’t let the payments get ahead of the work.

* Check references, and get at least three bids and a written contract before your project begins.

Handyman Insurance, SBA Makes It Easier for Small Businesses To Joint Venture for Federal Contracts

Small Business Administration (“SBA”) published a lengthy final rule that implements the long-awaited small business regulation changes mandated by the National Defense Authorization Act (“NDAA”) of 2013. The rule makes a number of very important changes affecting Federal contractors.  One of the more important changes makes it easier for small businesses to form joint ventures (JVs) to compete for government procurements and removes prior, and often confusing, restrictions.

A JV will now be considered as a small business for Federal procurement purposes as long as each individual JV partner would qualify alone as a small business under the relevant contract.  Essentially, this rule expands the exception to affiliation for all joint ventures where both concerns making up the JV are individually “small.” Of course, each small business must not otherwise be affiliated for different reasons.

Currently, in addition to the exclusion from affiliation given to an 8(a) protégé firm that joint ventures with its SBA-approved mentor for any small business procurement, there is also an exclusion from affiliation between two or more small businesses that seek to perform a small business procurement as a JV where the procurement is bundled or large (i.e., the value of the procurement is greater than half the size standard corresponding to the NAICS code assigned to the contract – for revenue based size standards, or $10 million for employee-based size standards).

The new rule, however, expands and clarifies this exception to affiliation, allowing small businesses to joint venture as long as both are small, regardless of the value of the procurement.  Thus, the size of the procurement no longer presents a restriction.

Handyman Insurance, SBA Issues Important Changes and Clarification Concerning Small Business Regulations

The Small Business Administration (“SBA”) has had a very busy week. First, on May 24, 2016, the agency issued “Statement of General Policy No. 3” (“the Statement”) clarifying the hotly debated inter-affiliate sales exclusion (an issue relating to the counting of annual receipts for purposes of determining size). Then, yesterday, the agency published a lengthy final rule, which implements the long-awaited small business regulation changes mandated by the National Defense Authorization Act (“NDAA”) of 2013. Collectively, the Statement and the rule make a number of very important changes affecting Federal contractors. Some of the most important changes are:

  • Changes regarding small business self-performance requirements and limitations on subcontracting pursuant to 13 C.F.R. § 125.6 (which we previously wrote about when the SBA issued its proposed rule, in December of 2014, and blogged about all the way back when the 2013 NDAA was enacted);
  • Expansion of exception to affiliation for all joint ventures where both concerns are individually “small” in connection with 13 C.F.R. § 121.103(h);
  • Clarification regarding what types of familial relationships will result in a rebuttable presumption of “identify of interest” affiliation pursuant to 13 C.F.R. § 121.103(f) (previously discussed here);
  • Addition of a rebuttable presumption of “identify of interest” affiliation pursuant to 13 C.F.R. § 121.103(f) based on 70% economic dependence between companies (previously discussed here);
  • Clarification regarding the calculation of annual receipts pursuant to 13 C.F.R. § 121.104, and, specifically, the exclusion from that calculation of inter-affiliate sales from a broader variety of affiliates;
  • Clarification regarding recertification following a merger or acquisition of a small business pursuant to 13 C.F.R. § 121.404(g)(2)(ii);
  • Changes regarding HUBZone certification pursuant to 13 C.F.R. § 126.200; and
  • Changes regarding who may file a size protest pursuant to 13 C.F.R. § 121.1001(a)

Unfortunately, the expansion of the Mentor-Protégé program – which everyone has anxiously been awaiting since the proposed rule was issued back in February, 2015 – was not addressed. In a March 4th interview, SBA’s Associate Administrator of Government indicated that the mentor-protégé final rule should be issued this summer, with a pilot program to start in the fall.

The “good driver and student discount” may be among the most common and can reduce rates quite a bit, but there are others available that a person may not even be aware is offered. Some discounts are automatically applied by insurers for such things as owning a vehicle equipped with safety features or anti-theft devices; individuals who put an aftermarket anti-theft device may have to provide proof of installation such as a receipt to receive a discount. Another type of savings that may be available is by having two vehicles (multi-car) or an automobile and home (multi-line) on the same policy.

The most recent way for Californians to save on automobile coverage is the Pay-As-You-Drive option. The California Department of Insurance just recently approved two carriers to provide premiums based on the actual mileage driven rather than an estimate given by the insured. The option to purchase this type of coverage will be available beginning February, 2011 and will be offered by two carriers. One of the companies that is going to provide the pay-as-you-drive option estimates that approximately 25% of current policyholders will choose this coverage and will save customers around $31 million dollars; it is thought that savings would be in the 5% range.
